64:75:04:18. New
placement items -- Special marking required. A wholesaler may furnish or
give any sample of alcoholic beverages pursuant to subdivision 64:75:04:10(1)
to a retail licensee if the sample has stamped thereon or securely affixed to
its brand label, in a space not less than one-half inch by two inches of clear
and legible type, the words: "Sample--Not for sale. The alcohol excise tax has not been
paid on this merchandise. Defacing this label by any retail licensee before
this container is emptied of its liquid contents is prohibited."
This section does not apply to malt
beverages and cider.
