NMSA 1978, § 7-38-59 — Certificates of sale; effect of certificates of sale
A.
Upon receiving payment for the personal property sold, the county treasurer shall
execute and deliver a certificate of sale to the purchaser.
B.
A certificate of sale:
(1) is prima facie evidence of the treasurer's right to make the sale and
conclusive evidence of the regularity of all proceedings relating to the sale;
(2) transfers all of the former property owner's interest in the personal
property as of the date of sale. The purchaser takes the personal property free of any
unrecorded or unfiled interests unknown to him at the time of sale; and
(3) shall be in a form prescribed by regulation of the department.
