Advisory opinions approved by the board

# (a)
No advisory opinion prepared under this subpart by the Director of Arkansas Tobacco Control, the Arkansas Tobacco Control Board’s staff or counsel, whether in draft or final form, shall be valid, official, or of any effect unless and until it has been approved by a vote of a majority of a quorum of the board.
# (b)
The director’s response to a request for an advisory opinion shall be prepared by the director in consultation with the board’s legal counsel, as appropriate, and presented by the director to the board for consideration.
