NMSA 1978, § 7-8A-27 — Transitional provisions
(a)
An initial report filed under the Uniform Unclaimed Property Act (1995) for
property that was not required to be reported before the effective date of that act, but
which is subject to that act, must include all items of property that would have been
presumed abandoned during the ten-year period next preceding the effective date of the
Uniform Unclaimed Property Act (1995) as if that act had been in effect during that
period.
(b)
The Uniform Unclaimed Property Act (1995) does not relieve a holder of a duty
that arose before the effective date of that act to report, pay or deliver property. Except
as otherwise provided in Section 19(b) [7-8A-19(b) NMSA 1978] of the Uniform
Unclaimed Property Act (1995), a holder who did not comply with the law in effect
before the effective date of that act is subject to the applicable provisions for
enforcement and penalties which then existed, which are continued in effect for the
purpose of this section.
