Money in workers' compensation collections suspense
fund; distribution.

# A.

After the necessary disbursements from the workers' compensation collections
suspense fund have been made, money remaining in the suspense fund as of the last
day of the month, less any deduction for administrative costs determined and made by
the department pursuant to Section 52-5-19 NMSA 1978, less any distribution made
pursuant to Subsection B of this section and less any amount determined by the
department to be retained in the suspense fund for the purpose of making refunds, shall
be distributed to the workers' compensation administration fund.

# B.

Upon certification by the New Mexico finance authority that a project is
sufficiently developed to warrant the issuance of bonds by the authority, the department
shall distribute the first forty cents ($.40) of each workers' compensation assessment
imposed pursuant to Section 52-5-19 NMSA 1978 to the New Mexico finance authority.
Upon certification by the authority, the department shall cease distribution to the
authority.
